The Chemsave "A chance to WIN $100,000 Cash" September Promotion

Terms & Conditions

  1. Information on how to enter and prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid. The Promoter's decision is final and no correspondence will be entered into.
  2. Entry is open to residents of Australia, aged 18 years and above only. Employees and their immediate families of the Promoter, Partners, Agencies and their related corporate bodies, are not eligible to enter this promotion. The Winner may be expected to complete a Statutory Declaration, evidencing their identity and age, before claiming their Prize.
  3. The Promotion commences at 12.01 am AEST on Friday 1 September 2017 and closes at 11.59pm AEST on Saturday 30 September 2017 ('promotion period').
  4. To enter the promotion, participants must make a purchase of any item advertised in the September 2017 Catalogue, (excluding prescription products), and, during the promotion period, either
    1. log on to http://www.chemsave.com.au/competition complete and submit the entry form, and upload a picture/image of their receipt, or
    2. complete the Entry Form in any participating Chemsave store and attach their receipt
  5. One chance in the draw for each eligible purchase. All eligible entries will be entered in the draw.
  6. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms & Conditions.
  7. The Prize draw will take place at 2.00pm (AEDT) on Wednesday 4 October 2017 at MDSA, 15 Grosvenor Street, Neutral Bay NSW 2089. All eligible entries received during the promotion period will be entered into the draw. The Winner will be notified by phone and in writing within 2 business days of the draw. The Winner's name will be published on http://www.chemsave.com.au/competition on Friday 6 October 2017 and in The Australian newspaper on Wednesday 11 October, 2017.
  8. The first valid and eligible entrant drawn will have the opportunity to select one sealed envelope from 100 sealed envelopes to reveal their Prize (the 'envelope selection').
  9. As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity form.
  10. The Grand Prize will be determined at the Envelope Selection. One (1) sealed envelope will contain the major "$100,000 Cash Prize" message, the remaining ninety-nine (99) sealed envelopes will each contain the minor "$10,000 Cash" message. The Winner will select one sealed envelope from 100 sealed envelopes to reveal their prize (Envelope Selection). The chance of the Winner selecting the $100,000 Cash is one in one hundred.
  11. The Envelope Selection will take place at 12.00pm on Friday 3 November 2017 at a location to be agreed between the Promoter and the Winner. The Winner will receive the prize set out in the envelope he/she selects. If the Winner is unable to attend the Envelope Selection, they may appoint a proxy to attend and choose an envelope in their absence, or may request that a representative of the Promoter choose the envelope on their behalf.
  12. The maximum value of the $100,000 Promotion is $100,000 cash and if selected, the amount will be transferred to the Winner's Bank Account, after verification by the Insurer, within 28 Days.
  13. If the winner doesn't select the envelope containing the "You've won $100,000" message, and selects the envelope containing the "You've won $10,000" message, they will win the minor Prize of $10,000 which will be transferred to the Winner's Bank Account, within 30 Days.
  14. Total maximum value of the Prize Bank is $100,000, which is correct at the time of the launch of the Promotion. The Promoter takes no responsibility for any variation in any element of the Prize.
  15. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
  16. The Winner is advised that tax implications may arise from them winning a Prize and they should seek independent financial advice prior to accepting the Prize.
  17. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  18. The Promoter reserves the right to redraw in the event of the Winner not claiming the Prize. If the Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further draw, as required, at the same time and place as the original draw, on Thursday 18 January 2018. The winner, if any, will be notified in writing and by phone within 2 business days of the redraw. Any second chance draw winner will be published in The Australian Newspaper on Wednesday 24 January 2018.
  19. If a redraw envelope selection is required, it will take place on Thursday 15 February 2018 at a location to be agreed between the Promoter and the Winner.
  20. If for any reason this promotion is not capable of running as planned (whether caused by infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion), the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  21. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
  22. The Promoter will collect information about entrants to include them in this Promotion and to award the Prize. Entries are deemed to be received at the time of receipt into the Promoter's database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information either caused by website users or by any of the equipment or programming associated or utilised in this competition, or by any technical error that may occur in the course of administration of this competition.
  23. By participating in this Promotion, entrants consent to the storage of their entry information on the databases of the Promoter, its related bodies and all Partners involved in this Promotion.
  24. The Promoter and its related bodies and/or Partners may use this information for future promotional and marketing purposes regarding their products and services, including contacting entrants via email, mail, phone and/or SMS without further reference or compensation to the entrant, for an indefinite period or until the entrant opts out from receiving offers or deals from any Partner involved with this Promotion. The email platform of some Partners may be housed outside Australia.
  25. By entering the promotion, each entrant agrees, in addition to the above, that the Promoter may disclose entrants' personal information, to State and Territory lottery departments, the winner's name will be published as required under the relevant lottery legislation and the Promoter may publish or cause to be published the winner's names and suburb in any media.
  26. The Promoter collects information about entrants, including names and contact details which entrants provide when participating in this Promotion. The Promoter collects and uses that information to provide opted-in entrants with targeted advertising, for the purposes described in the Promoter's Privacy Policy and for any other purposes, described at the time of collection. Further information about how the Promoter handles personal information, how opted-in entrants can complain about any breach of the Australian Privacy Principles, how The Promoter will deal with a complaint of that nature, how opted-in entrants can access or seek correction of any personal information and The Promoter's contact details in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available by contacting the Promoter, Chemsave Pty Ltd.
